|A.D.W.
was arrested on the 24th January 2010. During this arrest
he was severely beaten by the arresting police office for
close to 3 hours. This whole time he could not tell the
reason for his arrest. He was taken to court a week later
where for the first time heard his charge to be robbery
with violence. Out of the three of his co-accused he was
only familiar to one of them who was arrested together with
him as for the other two ladies he saw them on that day
in court while taking plea. While on our visit to prison
we sort to interview the two ladies at Langat Women’s’
Prison in regards to the case. The two ladies E.I. and E.O.
told us that their only connection to the robbery with violence
case was the fact that they were found being in possession
of one of the phone that is said to have been stolen during
the incident. However the most amazing thing is that the
person who sold the phone to them was not arrested yet the
police were well aware of this.
Further, an Identification parade was not conducted to them
yet this is one crucial procedure in such a case. For them,
4th March 2010 will be the 1st day that they will ever get
to see their complainant

One
would not know were to start in regard to the injustice
in this case. From the inconclusive and poor investigations
done by the very force that we trust or the breach of fundamental
rights, or the torture that A.D.W. was put through. By the
end of the day even an accused person deserves protection
unfortunately one is always guilty until proven innocent.
This is one of the cases that we are currently handling
with the hope that the justice that we seek shall be found
as one has a right to it regardless of their religion, tribe
or social status.
