Nairobi Cases Studies

The following case studies are recent examples of court and mediation work undertaken by CLEAR in our Nairobi office.  The clients' names have be altered to preserve their anonymity.


  • Civil Dispute-Negotiated Settlement

    In late 2015, KM took out a policy of fully comprehensive insurance on his car with a major insurance company (COY). KM subsequently loaned his car to a neighbour for an afternoon but neither the neighbour nor KM's car have been seen since. KM submitted an insurance claim to COY for the loss of his car which was initially refused on the grounds that KM had failed to “take all reasonable steps to safeguard [his motor vehicle]”. KM attempted to appeal the refusal of payment but in doing so posted a number of Facebook comments suggesting that COY had perpetrated a scam, been threatening and discriminatory-COY issued proceedings for defamation against KM in August 2016. KM attended the offices of CLEAR at the point in the defamation proceedings when he was required to file a defence, in some fear as he was dealing with a large insurance company which was demanding a high level of damages and costs out of all proportion to the money involved in the initial dispute. CLEAR obtained the services of a pro bono lawyer who was able to negotiate an end to proceedings; under the consent order that resulted from the negotiations, although KM was not paid out for the loss of his car he avoided any damages or costs to COY.
