Kisumu Cases Studies

The following case studies are recent examples of court and mediation work undertaken by CLEAR in our Kisumu office.  The clients' names have be altered to preserve their anonymity.


  • Child Maintenance-Pro Bono Representation and Negotiation

    Mother (M) was the day-to-day carer of two sons of school age since separating from Father (F) two years ago. F, who had been the main breadwinner during the marriage, had neglected to support M after their separation. The situation was made worse by M's disability following surgery which limited her ability to work. By the time CLEAR became involved, the children had dropped out of school (due to lack of funds for the fees) but M also lacked the funds to shelter, clothe and feed her sons or provide medication in the event of their illness. M needed the help of CLEAR as her attempts at informal negotiation had fallen on deaf ears and she was ignorant of court procedure (as well as being unable to pay for a lawyer to assist her). CLEAR took on M's case-when F refused to attend for mediation, CLEAR assisted M in drafting the necessary pleadings and provided a pro-bono lawyer to assist her at court. This assistance forced F to appoint a lawyer of his own and to negotiate a settlement which was formalised in a Consent Order by the court. Both children now have the basic necessities of life, in particular they have both returned to school.
