Mombasa Cases Studies

The following case studies are recent examples of court and mediation work undertaken by CLEAR in our Mombasa office.  The clients' names have be altered to preserve their anonymity.


  • Child Maintenance Mediation

    Mother (M) and her two month old son had been kicked out of their former family home by Father (F) since when she and her baby had been squatting on a veranda for shelter-M was seeking maintenance from F. A mediation meeting was arranged at the offices of CLEAR; F was clearly still angry with M, claiming that she had shamed him by attending a party wearing make-up and suggesting that their son should be cared for by a relative of his rather than by M. Through mediation, F relented slightly, withdrawing his suggestion that his son should be removed from M; F also made a low offer of maintenance, claiming that he lacked the funds to give more than a small amount of cash each month to M, though he accepted the need in addition to supplement the money needed for food and medication for his son. The offer was not accepted by M and the case seemed destined for court until the CLEAR mediator suggested a two-week cooling-off period (given the delay and expense involved in legal proceedings) to give the parties further time to reflect upon their positions. At the conclusion of the two-week period, F had revised his offer and was now prepared to both house and maintain M and son (subject to M agreeing to limit male visitors to her new home). As of April 2017 the agreement was holding up-M and son now being housed and maintained rather than squatting.
