Public Interest Litigation and Law Reform

CLEAR has access to highly qualified Kenyan and British lawyers who work pro-bono to conduct test case litigation to challenge unjust laws.
Through this work, CLEAR has successfully contributed to the reform of law concerning the harassment and arbitrary arrests of street children, the Government’s refusal to issue ID cards to the homeless and legal representation for victims of torture.  A total of 5 public interest cases were adopted in 2016.

In January 2016, Justice Willy Mutunga published the “Sentencing Policy Guidelines” to address concerns of “absurd, disproportionate and inconsistent sentences” . The Guidelines  were launched following the recommendations in a report published in 2015 by a taskforce appointed by Justice Muntunga. CLEAR Kenya is glad to have been part of this process, with Timothy Bryant, a CLEAR Kenya trustee, serving as part of the hand-picked task force.
